Digital Lead Services helps organizations leverage digital technologies and strategies to achieve their goals. We guide businesses through digital transformation, focusing on areas such as strategy, implementation, and change management. The specific scope, deliverables, and terms of any engagement will be defined in a separate service agreement or statement of work between you and Digital Lead Services.

3. Accounts

To access certain features of the Services, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your login credentials confidential and not share them with any third party.
  • Accept responsibility for all activity that occurs under your account.

You must notify us immediately at shadi@digitalleadservices.com if you believe your account has been compromised. We reserve the right to suspend or terminate any account at our discretion.

4. Purchases and Payment

If you make a purchase through the Site, you agree to provide accurate and complete payment information. All payments are processed through our third-party payment processor(s). By submitting payment, you represent that you are authorized to use the payment method provided.

All fees are stated in U.S. dollars unless otherwise indicated. Prices are subject to change without notice. We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud or unauthorized transactions.

5. Cancellation, Returns, and Refunds

6. SMS/Text Messaging Terms

Program Description

When you opt in to the Digital Lead Services SMS program, you agree to receive recurring automated text messages (SMS and MMS) from Digital Lead Services. These messages may include, but are not limited to: order and service notifications, delivery and appointment updates, account alerts, customer support communications, promotional offers, and marketing messages. The SMS program is used to communicate essential information about our digital transformation services and to send marketing and promotional content to opted-in subscribers.

Consent and Opt-In

By providing your phone number and checking the consent checkbox on our website, completing a contact form, texting a keyword to our number, or otherwise opting in, you expressly consent to receive recurring automated text messages from Digital Lead Services at the phone number you provided. You are not required to consent to receive text messages as a condition of purchasing any goods or services from Digital Lead Services. Consent to receive marketing text messages is optional and not required.

Age Restriction

You must be at least 18 years of age to opt in to the Digital Lead Services SMS program. By opting in, you confirm that you are at least 18 years old.

Message Frequency

Message frequency varies depending on your interactions with us and the types of messages you have opted into. Recurring messages may be sent. You may receive multiple messages per week.

Message and Data Rates

Message and data rates may apply. Standard messaging fees from your wireless carrier may be charged for each message sent and received. Digital Lead Services is not responsible for any fees or charges imposed by your mobile carrier. Please contact your carrier for details about your plan and any applicable charges.

Opt-Out

You may opt out of receiving text messages at any time by texting STOP to any message you receive from Digital Lead Services. After texting STOP, you will receive a single confirmation message acknowledging your opt-out request. No further text messages will be sent to you unless you re-subscribe. Opting out of text messages does not affect your ability to use the Services or receive emails from us.

No Sharing of Consent or Phone Numbers

We do not sell, rent, or share your phone number or your consent to receive text messages with any third parties or affiliates for their own marketing purposes.

Carrier Liability Disclaimer

Digital Lead Services and mobile carriers (including but not limited to T-Mobile) are not liable for delayed or undelivered messages. Delivery of text messages is subject to effective transmission by your wireless carrier. T-Mobile is not liable for delayed or undelivered messages. Carriers are not responsible for the content of any messages sent through the Digital Lead Services SMS program.

Privacy Policy

Your use of the Digital Lead Services SMS program is also subject to our Privacy Policy, available at https://digitalleadservices.com/policies/privacy-policy. Our Privacy Policy describes how we collect, use, and protect your personal information, including your phone number and messaging data.

7. Intellectual Property

All content, materials, trademarks, logos, designs, text, graphics, and software on the Site are the property of Digital Lead Services or our licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from the Site without our prior written consent.

8. User Conduct

You agree not to:

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

DIGITAL LEAD SERVICES DOES NOT GUARANTEE ANY SPECIFIC RESULTS FROM THE USE OF OUR SERVICES. ANY PROJECTIONS, ESTIMATES, OR FORECASTS PROVIDED IN CONNECTION WITH OUR SERVICES ARE FOR INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE A GUARANTEE OF PERFORMANCE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DIGITAL LEAD SERVICES, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE AMOUNT PAID BY YOU TO DIGITAL LEAD SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Digital Lead Services and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of such courts.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy (available at https://digitalleadservices.com/policies/privacy-policy) and any applicable service agreements, constitute the entire agreement between you and Digital Lead Services regarding your use of the Services and supersede any prior agreements.
